Zusammenfassung
Bei der Beurteilung der Verhandlungsfähigkeit bzw. -unfähigkeit werden für die Entscheidungen des Gerichtes ärztliche Atteste oder Gutachten benötigt. Die nachfolgenden Ausführungen sollen Schwierigkeiten bei der Beurteilung der Verhandlungsfähigkeit bei Personen mit Schlafstörungen aufzeigen und eine Hilfestellung für die praktische Gutachtertätigkeit geben.
Abstract
The legal capacity and fitness of a person to stand trial have to be examined by medicolegal experts. The assessment of the competency to stand trial in persons with sleep disorders can be quite difficult. Therefore, it is necessary for the physician involved to have a full understanding of sleep medicine, including sleep pathophysiology, sleep disorders, neuropsychology, and drugs. A review is given for assisting practical work in the medicolegal field.
